Terms and Conditions
The terms under which MagnoHost provides game servers, Discord bot hosting, web hosting and virtual servers.
Version 1.0 · effective from 27 October 2026
These terms are a draft prepared before launch. A lawyer must review them before the service goes live. Items marked [TO BE ADDED] are still missing. This is an English translation; if it differs from the Czech version, the Czech version prevails.
1. Who provides the services
Services under the MagnoHost brand are provided by:
- Martin Matúšek - MM Tire, a sole trader (natural person)
- business address: Stupavská 1358/68, 901 01 Malacky, Slovak Republic
- Company ID (IČO): 56 856 911, registered in the Trade Register of the District Office Malacky, No. 120-30225
- The operator is not registered for VAT.
- e-mail: podpora@magnohost.cz, phone: 606792659
(the “operator”). MagnoHost is the operator's trading brand, not a separate company.
2. Definitions
- Customer means anyone who creates a customer account with the operator or orders a service.
- Consumer means a customer who is a natural person ordering services outside their business or profession. Provisions marked “for consumers” apply only to consumers. Other customers (businesses and legal entities) are referred to as business customers.
- Service means a specific plan ordered, for example a Minecraft server, Discord bot hosting, web hosting or a virtual private server (VPS).
- Customer area means the web application at [TO BE ADDED] where the customer manages their account, orders, invoices, payments and support requests.
- Control panel means the web application where the customer operates their server (console, files, backups). It is linked from the customer area for each service.
- Billing period means the period for which the service is prepaid (for example one month). It is stated in the order and on the invoice.
3. Conclusion of the contract
- A customer account is required to order. When registering, the customer provides true and complete details and keeps them up to date.
- Customers must be at least 18 years old. A minor may only receive a service ordered by their legal guardian, who then becomes the customer.
- The customer chooses a plan and billing period. Before sending the order, they see a summary including the total price and can correct any input errors.
- The customer sends the order by clicking “Order with obligation to pay”. By doing so they confirm that they have read and agree to these terms.
- The contract is concluded when the order is sent. The operator confirms receipt of the order by e-mail and in the customer area.
- The contract is concluded in Czech (an English translation is provided for information). The operator stores it electronically; the customer can access orders and invoices in the customer area. These terms are permanently available on the website and with every order.
- The operator is not bound by any code of conduct.
4. Price and payment
- Prices are shown for each plan on the website and in the customer area. They are final. The operator is not registered for VAT. No further fees (for example a setup fee) are charged unless clearly stated for the plan before the order is sent.
- Services are paid in advance for the whole billing period.
- Available payment methods are shown before the invoice is paid (for example card payment via a payment gateway). Card payments are processed by the payment gateway provider; the operator does not receive or store card details.
- If the customer enables automatic payment in the customer area (a saved payment method), the price of the next period will be charged automatically. The customer can cancel automatic payment at any time in the customer area.
- The operator issues an invoice for each order. Invoices are available in the customer area.
- If an order is not paid within 7 days of being sent, the operator cancels it and the contract ends.
5. Service activation
- The service is set up automatically once payment is received, usually within a few minutes.
- If automatic setup fails, the operator sets the service up manually without undue delay, no later than 3 business days after the payment is received. If that is not possible, the operator informs the customer and refunds the full amount paid.
- Access details for the control panel and the service are in the customer area.
6. Term, renewal and cancellation
- The contract is concluded for an indefinite period and the service is renewed for each further billing period by paying the invoice.
- The operator issues the invoice for the next period 7 days before the current period ends and reminds the customer before it is due. The due date is the last day of the current period.
- If the invoice is not paid by the due date, the operator proceeds as follows (paying the invoice before cancellation restores a suspended service):
- 2 days after the due date the service is suspended (the server is stopped, data remain stored),
- 14 days after the due date the service is cancelled and its data are irreversibly deleted.
- The customer may cancel a service at any time in the customer area. Cancellation does not refund the unused part of a period already paid; this does not affect a consumer's right of withdrawal (Article 8) or rights in respect of defects (Article 10). The customer chooses between cancellation:
- at the end of the billing period – the service runs until the end of the paid period and is then cancelled,
- immediately – the service ends at once and its data are deleted.
- The operator may terminate the contract with one month's notice sent by e-mail. The operator will refund the proportional part of the price for the period after the service ends.
- The operator may suspend the service or terminate the contract with immediate effect if the customer materially breaches these terms, in particular Article 7. Where possible, and unless the protection of third parties or network security prevents it, the operator first asks the customer to remedy the breach.
- Before a service is cancelled, the customer must back up any data they want to keep. After cancellation the operator irreversibly deletes the service data and does not keep them.
7. Acceptable use
The customer must not use the service for activities that are unlawful or harm the operator or others. In particular it is prohibited to:
- distribute content that is illegal, infringes copyright or other third-party rights, or depicts child sexual abuse,
- attack other systems (DDoS, port scanning, password cracking), distribute malware or run phishing,
- send unsolicited e-mail (spam),
- mine cryptocurrencies,
- run open proxies, VPN exit nodes or services intended to circumvent blocking,
- deliberately overload shared resources beyond the plan or circumvent technical limits of the service,
- breach the licence terms of software run on the service.
For Minecraft game servers the customer complies with the Minecraft End User Licence Agreement (EULA) and Mojang's usage guidelines. For Discord bots the customer complies with Discord's terms of service. The operator is not affiliated with Mojang, Microsoft or Discord.
The customer is responsible for the content and software they run on the service.
8. Right of withdrawal (for consumers)
- A consumer may withdraw from the contract without giving any reason within 14 days of the day the contract was concluded.
- When ordering, the consumer expressly requests that the operator start providing the service immediately after payment, i.e. before the withdrawal period ends. If the consumer then withdraws, they pay the operator a proportional amount for the time the service ran until the withdrawal. The operator refunds the rest.
- The easiest way is the online form on the [Withdrawal from Contract](/withdrawal) page. A consumer can also withdraw by e-mail to podpora@magnohost.cz or by letter to the operator's address, for example using the model form on the same page. It is sufficient to send the withdrawal on the last day of the period.
- The operator confirms receipt of the withdrawal by e-mail without undue delay.
- The operator refunds the payment within 14 days of receiving the withdrawal using the same means of payment the consumer used, unless agreed otherwise. The consumer incurs no further costs.
- Detailed information is on the Withdrawal from Contract page.
9. Availability, maintenance and backups
- The operator aims to run the services continuously. No contractual availability (SLA) is guaranteed unless expressly stated for the plan.
- Planned maintenance during which the service may be unavailable is announced in advance in the customer area or by e-mail where possible. Urgent security work may be done without prior notice.
- The service may also be briefly unavailable for reasons beyond the operator's control (data centre outage, network attack, force majeure).
- Customers create backups themselves in the control panel within the limits of their plan. The operator does not guarantee that it holds backups of customer data unless expressly stated for the plan. We recommend keeping important backups outside the service as well.
10. Defects and complaints
- The operator is responsible for the service conforming to the contract and the plan description throughout the period it is provided.
- Defects are reported under the Complaints Policy, preferably through a support request in the customer area or by e-mail.
11. Liability
- The operator is liable for damage in accordance with the law.
- The operator is not liable for the customer's content, data or software, for damage caused by the customer's breach of these terms, or for data loss that the customer could have prevented with their own backup.
- For business customers: the operator's liability for damage is limited to the amount the business customer paid for the affected service in the last 12 months. The operator is not liable for lost profit. This limitation does not apply to damage caused intentionally or by gross negligence.
- These terms do not limit any rights a consumer has under the law.
12. Personal data and customer data on the service
- How the operator processes customers' personal data is described in the Privacy Policy.
- If the customer stores other people's personal data on the service (for example players or visitors to their website), the customer is the controller of those data and the operator processes them as a processor only to the extent necessary to run the service. The operator:
- processes the data only on the customer's instructions given by the contract and the service settings,
- binds everyone with access to the data to confidentiality,
- takes appropriate technical and organisational measures to secure the data,
- uses further processors (in particular data centre providers) only if they are listed in the Privacy Policy; it informs the customer of changes, and the customer may object by terminating the contract,
- assists the customer, without undue delay, with requests from data subjects and with notifying security breaches,
- deletes the data after the service ends (Article 6),
- provides the information needed to demonstrate compliance with these obligations.
- The operator does not interfere with customer data on the service, except for necessary technical intervention (for example when handling a customer request or a security threat) or where required by law.
13. Dispute resolution and supervision
- Customers send complaints to podpora@magnohost.cz or via the customer area. The operator handles them without undue delay.
- Alternative dispute resolution (for consumers): If a consumer is not satisfied with how a complaint was handled or believes the operator has breached their rights, they may first contact the operator. If the operator rejects the request or does not reply within 30 days, the consumer may submit a proposal for alternative dispute resolution to the Slovak Trade Inspection (www.soi.sk) or another authorised body listed by the Ministry of Economy of the Slovak Republic. Consumers from the Czech Republic may also contact the European Consumer Centre Czech Republic (www.evropskyspotrebitel.cz).
- Compliance with consumer protection law is supervised by the Slovak Trade Inspection, Inspectorate for the Bratislava Region, Bajkalská 21/A, Bratislava. Data protection is supervised by the Office for Personal Data Protection of the Slovak Republic.
- The contract is governed by Slovak law. This does not deprive a consumer of the protection afforded by mandatory provisions of the law of the country where they habitually reside.
14. Changes to these terms
- The operator may change these terms, in particular due to changes in the law, the services offered or the technical solution.
- The operator notifies customers of a change by e-mail at least 30 days before it takes effect. A customer who disagrees may terminate the contract before the change takes effect without penalty; the operator refunds the proportional part of the price for the unused period.
- For a billing period already paid, the price valid at the time of payment applies.
15. Final provisions
- If any provision of these terms is invalid, the other provisions remain in force.
- These terms are effective from 27 October 2026. If the English translation differs from the Czech version, the Czech version prevails.
